EC Type Approval / Spray Suppression
EC Type Approval is a legal requirement for all EU countries to have a common process for the "approval of motor vehicles and their trailers and of systems, components and separate technical units intended for such vehicles." This means the scope of European approval has been extended from cars to all Commercial Vehicles and trailers. The manufacturer can apply for homologation in any member state.
The relevant directive for EC Type Approval is frame directive 2007/46/EC which was introduced on 29 October 2007 and provides a European-wide mechanism for ensuring that these vehicles meet appropriate environmental and safety standards.
To obtain above homologation, vehicles of categories N and O must be fitted with anti-spray devices according to Regulation (EC) No. 661/2009 amended by Regulation (EC) No. 407/2011. The former repeals ‘Spray Directive’ 91/226/EEC amended by Directive 2010/19/EU. The requirements set out in Directive 91/226/EEC are to be carried over to this Regulation. Regulation (EU) No 109/2011 implements Regulation (EC) No. 661/2009. The former ‘shall be binding in its entirety and directly applicable in all Member States’. Member states must not refuse to grant EC or national type approval to a vehicle complying with above requirements, but must refuse both EC and national type approval should a vehicle not comply with these requirements. When applying for EC type approval for completed vehicles under above Frame Directive, vehicle types which already were granted type approval covering spray suppression, EC or national, need not comply with the Regulation (EC) No. 661/2009.
Note: Off-road vehicles are defined in Annex II (Point 4) in Directive 2007/46/EC are exempted.
Important things to rememberWith effect from 01 November 2014 Regulation (EC) No. 661/2009 repeals 50 Directives in Annex IV of Frame Directive 2007/46/EC and replaces them with equivalent UNECE Regulations (United Nations Economic Commission of Europe) as detailed in Regulation (EC) No 407/2011.
